FDA To Appeal Tobinco Case Judgment

The Food and Drugs Authority (FDA) has voiced its dissatisfaction with the court decision that gave Tobinco Pharmaceutical Limited a judgment debt against the Authority. Tobinco Pharmaceutical Limited was awarded a judgment debt of GH¢93,905,760.79 at the end of the lengthy court struggle last month. In 2019, the company launched a lawsuit against the FDA after the Authority destroyed Tobinco products on the grounds that the company was importing counterfeit goods into the nation.

According to reports that surfaced after the ruling, the FDA lost the lawsuit because it was unable to put up a compelling legal case. Claims that the Authority would not be able to mount a compelling argument in court were refuted by the Authority in a statement released on August 15. It claimed that the FDA’s current leadership offered a strong defense at all relevant point throughout the court proceedings, in spite of the accusations made by Tobinco Pharmaceuticals Ltd. against previous CEO Dr. Stephen Opuni.

This decision, made on July 29, 2024, at the High Court in Accra by Her Ladyship Audrey Kocuvie-Tay, refuted allegations made by Dr. Stephen Kwabena Opuni, the former CEO of the Food and Drugs Authority (FDA), that the corporation had brought in counterfeit goods.
