According to a statement made by the Judicial Service of Ghana (JSG), parties to the Anti-LGBTQ+ Bill cases have not completed the work they are to do before a hearing by the Supreme Court can be conducted. This announcement comes after rumors circulated that the sponsors of the Ghanaian Family Values Bill and the Promotion of Proper Human Sexual Rights were to demonstrate against the Chief Justice on September 17.
The bill’s sponsor, the Member of Parliament (MP) for Ningo-Prampram, stated in the report that on September 17, 2024, they would stage a protest known as the “Family Values March” in which they would march against the Chief Justice. The MP claims that the Chief Justice’s “deliberate and malicious” attempt to postpone the bill’s enactment into law was the reason behind the Supreme Court’s decision on July 17, 2024, to postpone ruling on the interlocutory injunction to prevent Parliament from transmitting the Anti-LGBTQ Bill to the President for assent until the substantive case is heard. This led the demonstrators to call for a hearing schedule.
Richard Sky’s case started with a writ that was filed on March 5, 2024, according to a statement released by the JSG on Friday. Neither the Attorney General (2nd Defendant) nor Parliament (1st Defendant) had submitted a defense in the form of their Statements of Case as of July 31, 2024, the date the Supreme Court went into recess. The JSG stressed that the Supreme Court could not hear the matter until the Statements of matter were in place, at which point the three parties could only file the Memorandum of Issues for the trial.
According to the JSG, Dr. Amanda Odoi’s lawsuit against the Speaker and Attorney General began with a writ that was submitted on June 11, 2023. According to the JSG, the Supreme Court cannot hear a matter before the individual or joint Memorandum of Issues has been filed. The JSG gave the public the assurance that all processes that are scheduled to be filed can be received by visiting the registries of the Supreme Court, Court of Appeal, and High Courts throughout the legal, Christmas, and Easter vacations.
