A federal judge has ruled that a woman who accused music mogul Sean “Diddy” Combs of sexual assault cannot proceed with her lawsuit under a pseudonym. Judge Mary Kay Vyskocil determined that Combs has a right to know the identity of his accuser to adequately defend himself, underscoring the importance of transparency in judicial proceedings.
In her written opinion on Wednesday, Judge Vyskocil explained, “The fundamental question is whether Plaintiff has a ‘substantial privacy’ interest that ‘outweighs the customary and constitutionally-embedded presumption of openness in judicial proceedings.’ Defendants have a right to defend themselves, including by investigating Plaintiff, and the people have a right to know who is using their courts.”
The woman, identified only as Jane Doe, filed the lawsuit in October, alleging that Combs raped her in 2004 when she was 19. However, the court has ordered her to reveal her real name by November 13 or risk dismissal of the case. The judge emphasized that, given the lack of recent contact between Combs and the accuser and the fact that Combs is currently detained pending trial, the plaintiff’s fear of potential harm does not justify anonymity.
This decision could have implications for more than a dozen similar lawsuits filed against Combs since his recent arrest on sex trafficking and racketeering charges. While Combs has denied the allegations, his legal team refrained from issuing a formal statement, saying the ruling speaks for itself.
The woman’s lawyers had argued that anonymity was essential, fearing Combs might retaliate. However, Judge Vyskocil dismissed this claim, noting that no current threat to the plaintiff had been substantiated. However, she asserted that the public’s right to an open judicial process outweighs concerns of potential embarrassment. Representatives for Combs reaffirmed that he has pleaded not guilty to all charges and maintains his innocence amid the mounting allegations.
