Vacant seats: Dafeamekpor takes Speaker to the High Court

South Dayi MP, Rockson-Nelson Dafeamekpor, has taken legal action against Speaker Alban Bagbin in the Accra High Court over a controversy involving vacant parliamentary seats. The MP contends that the Speaker’s decision aligns with Article 97(1)(g) and (h) of the 1992 Constitution, thereby making it valid.

In his court filing, Dafeamekpor seeks an order compelling Speaker Bagbin to officially declare the four parliamentary seats vacant as of Thursday, October 17, 2024. He argues that these seats should be vacated since the respective MPs have chosen to contest as independent candidates in the upcoming elections.

The writ specifically calls for Speaker Bagbin to affirm that MPs Andrew Amoako Asiamah (Fomena), Cynthia Mamle Morrison (Agona West), Kwadwo Asante (Suhum), and Peter Yaw Kwakye-Ackah (Amenfi Central) no longer hold seats in Parliament. Additionally, he seeks a ruling that any future parliamentary sittings involving these members be deemed unlawful and invalid.

Dafeamekpor further requests that these MPs be barred from accessing the parliamentary chamber or participating in proceedings.

This development comes after the Supreme Court, on October 18, issued a stay of execution on Speaker Bagbin’s declaration regarding the four seats. The stay followed a petition filed by former Tamale South MP and former Minority Leader, Haruna Iddrisu. The Supreme Court’s decision also came in response to an ex parte application from NPP MPs, allowing the court to review their petition without requiring Speaker Bagbin or other parliamentary authorities to respond at this stage.
