A model has received a suspended prison sentence and a fine after admitting to fabricating a rape accusation against AC Milan footballer Theo Hernandez.
Luisa Kremleva, 28, was sentenced to six months in prison, suspended for two years, and fined £1,500 following a plea bargain deal with prosecutors. The Russian-born model confessed to perjury, acknowledging that her claim of being raped by the French international defender in the back of a Porsche outside a Marbella nightclub was false.
The case, which began last October, was delayed when Kremleva’s lawyer called in sick at the last moment, citing a “medical emergency.” This forced the postponement of her trial, during which public prosecutors had sought a two-year prison term. Kremleva avoided appearing in court in Malaga, reportedly to avoid the media presence.
Court officials confirmed on Thursday that Kremleva’s plea deal was finalized in November, although the five-page sentence was only made public now. Under the terms of her suspended sentence, she has been warned that any criminal offense within the next two years will lead to her serving the jail term.
Kremleva’s false allegation against Hernandez, 27, drew widespread attention when she initially accused him of assault. Her admission of perjury concludes a controversial case that had significant legal and reputational implications for the AC Milan player.
This conviction underscores the seriousness of making false criminal complaints, with Kremleva formally convicted of filing a fraudulent claim to authorities.

A nearly seven-year-long legal battle has concluded with the conviction of model Luisa Kremleva, who falsely accused AC Milan footballer Theo Hernandez of rape in June 2017. Kremleva, a former reality TV star and model, was handed a six-month suspended prison sentence and fined £1,500 after admitting to fabricating her allegations as part of a plea bargain.
The case began on June 4, 2017, when Kremleva accused Hernandez of raping her in the back of a Porsche Cayenne outside Marbella’s Olivia Valere nightclub, a popular luxury venue where the two had been partying. Kremleva claimed that Hernandez forced himself on her and pushed her out of the vehicle, causing injuries to her knees and backside.
However, investigators quickly dismissed her claims after reviewing CCTV footage from the nightclub’s parking lot, which showed Kremleva falling accidentally. Additional evidence, including text messages sent to Hernandez at 6:15 a.m.—two hours after the alleged assault—revealed her asking him when they could leave together. Hernandez was never arrested, and the case against him was formally dropped after investigators concluded her claims were baseless.
Instead, the focus shifted to Kremleva. She was arrested in January 2020 after failing to respond to court summonses and charged with making a false criminal complaint. Court documents later revealed that Kremleva’s actions stemmed from “revenge,” as she had been upset that Hernandez declined her attempts to spend the night with her after their consensual encounter in the car.
In the plea bargain deal, Kremleva admitted to fabricating the story. Sentencing judge Lourdes Sanchez Esquinas wrote in her ruling:
“It has been proven that in the early hours of June 4, 2017, the accused, Luisa T.K., met Theo H. at Olivia Valere nightclub, where he was in a VIP section with friends. Around 4 a.m., they left the club, had consensual sex in a car, and returned to the venue.
“Later, the accused attempted to convince Theo to spend the night alone with her. When her advances were rejected, she got into an altercation with other women in Theo’s group before leaving the nightclub alone. By 8 a.m., motivated by revenge and exploiting Theo’s fame, she contacted the police, falsely accusing him of rape.”
Despite her initial claims of injuries caused by Hernandez, the court found she had sustained them during unrelated incidents, including a fall and a physical altercation earlier that morning.
Kremleva’s conviction not only clears Hernandez’s name but also highlights the toll the case has taken on the footballer, who was poised to testify at her trial last year. Hernandez, now a key player for AC Milan, continues to excel in his career. He recently played a pivotal role in his team’s dramatic 3-2 victory over Inter Milan in the Italian Super Cup, scoring one goal and assisting another.
The resolution of this case underscores the importance of accountability in legal matters and brings closure to a long-standing controversy surrounding the French international footballer.
