The Commission on Human Rights and Administrative Justice (CHRAJ) has called on public officers, particularly members of the new government and the ninth Parliament, to uphold ethical governance by adhering to the “Code of Conduct for Public Officers” outlined in Chapter 24 of the 1992 Constitution.

In a statement released on Thursday, January 16, CHRAJ stressed the importance of integrity, accountability, and the avoidance of conflicts of interest in public service. The Commission reminded officials that public office is a position of trust, requiring an unwavering commitment to the public good.

Citing Article 284 of the Constitution, CHRAJ emphasized that public officers must ensure their personal interests do not interfere with their official responsibilities or create the perception of a conflict of interest.

The Commission also underscored the legal obligation outlined in Article 286(1) of the Constitution and the Public Office Holders (Declaration of Assets and Disqualification) Act, 1998 (Act 550). This law mandates that public officers declare their assets and liabilities to the Auditor-General before assuming office.

CHRAJ expressed concern over widespread non-compliance with these requirements, noting that many public officials either disregard or are unaware of their constitutional duties, leading to unethical practices and governance challenges.

“From experience, the Commission has observed that public officers either treat the Code of Conduct with contempt or, in the case of new appointees, ignore it entirely. This results in unethical conduct and behavior,” the statement read.

To address these concerns, CHRAJ urged all public officials to take immediate steps to familiarize themselves with the Code of Conduct and comply with asset declaration requirements.

“The Commission strongly advises public officers in the new government, the ninth Parliament, and beyond to acquaint themselves with the Code of Conduct and declare their assets in line with the law before assuming office,” CHRAJ stated.

The Commission also called on the government to expedite the passage of the Conduct of Public Officers Bill, a measure it believes would strengthen the legal framework for promoting ethical standards in public service.

CHRAJ’s appeal serves as a reminder of the critical role ethical governance plays in fostering trust and accountability in national development.
